These Terms and Conditions govern your use of Gilt Arbor's watch repair services and website. By engaging our services, you agree to these terms.
1. Definitions
In these Terms and Conditions:
- "Service" or "Services" refers to all watch repair, restoration, and related horological services provided by Gilt Arbor
- "Client," "You," or "Your" refers to the individual or entity engaging our services
- "We," "Us," or "Our" refers to Gilt Arbor
- "Timepiece" or "Watch" refers to any watch or horological instrument submitted for service
- "Agreement" refers to these Terms and Conditions together with any service proposal or work order
2. Acceptance of Terms
By submitting a timepiece for service or engaging with our services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
You must be at least 18 years of age to use our services. By agreeing to these terms, you represent that you have the legal capacity to enter into a binding agreement.
3. Service Description
Gilt Arbor provides professional horological services including:
- Crystal polishing and replacement
- Mechanical movement overhaul and service
- Signature restoration projects
- Related watch repair and maintenance services
Services are provided at our workshop located in Taipei, Taiwan. We reserve the right to refuse service for any timepiece at our discretion, particularly if we determine the work required exceeds our capabilities or available resources.
4. Service Process
4.1 Initial Assessment
Upon submission of your timepiece, we conduct an initial assessment to determine the required work. This assessment is provided without obligation.
4.2 Service Proposal
For services beyond simple crystal work, we provide a written proposal outlining the recommended work, estimated timeline, and pricing. Work does not begin until you approve this proposal.
4.3 Additional Work
If additional work is discovered during service, we will contact you for approval before proceeding. You are not obligated to authorize additional work beyond the original proposal.
4.4 Timeline
Timeline estimates are provided in good faith based on typical service requirements. Actual completion time may vary due to parts availability, complexity of work, or unforeseen issues. We will notify you of any significant delays.
5. Client Responsibilities
5.1 Ownership Verification
You represent and warrant that you are the legal owner of any timepiece submitted for service or have authorization from the owner to submit it for service.
5.2 Accurate Information
You agree to provide accurate information about the timepiece's history, previous repairs, and any known issues. Failure to disclose relevant information may affect service quality or timeline.
5.3 Timely Collection
You agree to collect your timepiece within 30 days of service completion notification. Timepieces not collected within this period may be subject to storage fees of NT$500 per month.
6. Pricing and Payment
6.1 Service Fees
Pricing for standard services is available on our website. For complex projects, pricing is provided in a written proposal before work begins. All prices are in New Taiwan Dollars (NT$) and include applicable taxes.
6.2 Payment Terms
Payment is due upon completion of service before the timepiece is returned. We accept cash, bank transfer, and major credit cards. Timepieces will not be released until payment is received in full.
6.3 Parts and Materials
The cost of replacement parts and materials is included in service fees unless otherwise specified in the service proposal.
7. Warranty
7.1 Service Warranty
We provide a 12-month warranty on all work performed and parts installed, covering defects in workmanship or materials. This warranty does not cover normal wear, damage from misuse, or issues unrelated to our service.
7.2 Warranty Exclusions
The warranty does not cover:
- Damage caused by accidents, misuse, or unauthorized repairs
- Normal wear and tear of components
- Water damage if the watch was not serviced for water resistance
- Issues arising from parts or problems not addressed in the original service
- Vintage timepieces with inherent limitations due to age
7.3 Warranty Claims
To make a warranty claim, contact us within the warranty period. We will assess the issue and, if covered, repair or adjust the work at no additional charge.
8. Limitation of Liability
We exercise due care in handling all timepieces. However, watch repair involves inherent risks, particularly with vintage or delicate pieces.
8.1 Liability Cap
Our liability for any damage, loss, or issue related to your timepiece is limited to the lesser of the timepiece's declared value or NT$500,000. This limitation applies regardless of the cause of damage or loss.
8.2 Excluded Damages
We are not liable for:
- Sentimental or emotional value
- Consequential or indirect damages
- Loss of use or opportunity
- Issues discovered but not caused by our service
9. Risk Acknowledgment
By submitting a timepiece for service, you acknowledge that:
- All watch repair involves some degree of risk
- Vintage or severely damaged timepieces carry higher risk
- Some parts may be unavailable or difficult to source
- Complete restoration to original condition may not be possible
- We will inform you of significant risks before beginning work
10. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Gilt Arbor and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Photographic documentation of service work remains our property but is licensed to you for personal use.
11. Privacy
Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to the collection and use of information as described in that policy.
12. Termination
12.1 Service Cancellation
You may cancel service at any time before work begins by notifying us in writing. Once work has commenced, you remain responsible for payment of work completed to that point.
12.2 Our Right to Refuse Service
We reserve the right to refuse or discontinue service if we determine the work is beyond our capabilities, if parts cannot be sourced, or if we cannot reach agreement on terms.
13. Dispute Resolution
13.1 Governing Law
These Terms and Conditions are governed by the laws of Taiwan. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Taipei, Taiwan.
13.2 Informal Resolution
Before initiating any formal proceeding, we encourage you to contact us to discuss resolution of any dispute. Many issues can be resolved through direct communication.
14. General Provisions
14.1 Entire Agreement
These Terms and Conditions, together with any service proposal or work order, constitute the entire agreement between you and Gilt Arbor regarding our services.
14.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not transfer or assign your rights under these terms without our written consent. We may assign our rights and obligations under these terms to a successor entity.
15. Changes to Terms
We may update these Terms and Conditions from time to time. Changes will be posted on our website with an updated "Last Updated" date. Significant changes will be communicated to active clients via email.
Your continued use of our services after such changes constitutes acceptance of the updated terms.
